Terms of Service

These Terms of Service ("Terms") govern your access to and use of TAPE ("TAPE", "we", "us"), the influencer-marketing platform at createwithtape.com. By using TAPE you agree to these Terms. If you do not agree, do not use the service.

1. The service

TAPE helps agencies and brands plan campaigns, produce and review short-form videos, track post performance, and publish content to connected channels. Features may change over time.

2. Accounts & eligibility

You must be at least 18 years old and able to enter into a binding agreement. You are responsible for activity under your account and for keeping your credentials secure.

3. Your content

You retain ownership of the content you upload or create in TAPE. You grant us a limited licence to host, process, and display that content solely to operate the service for you — including generating transcripts, clips, captions, and quality-control reports, and publishing content to the channels you connect at your direction.

4. Connected third-party accounts

When you connect a YouTube channel, Instagram account, or other third-party account, you authorise TAPE to take the actions you request on your behalf (for example, uploading a video to your YouTube channel). You are responsible for having the rights and permissions to connect that account and to publish the content you upload.

TAPE uses YouTube API Services. By using features that rely on them, you also agree to be bound by the YouTube Terms of Service, and you acknowledge that Google's use of your data is governed by the Google Privacy Policy. Your use of connected platforms must also comply with those platforms' own terms and policies.

5. Acceptable use

  • Only upload or publish content you own or are authorised to use.
  • Do not upload unlawful, infringing, deceptive, or harmful content.
  • Do not misuse, overload, reverse-engineer, or attempt to gain unauthorised access to the service.
  • Comply with the terms and policies of any platform you connect.

6. Publishing to your channels

You are solely responsible for the content published to your connected channels through TAPE and for ensuring it complies with the relevant platform's policies. Publishing is subject to third-party limits and quotas outside our control.

7. Fees

Any fees, plans, and billing terms will be provided to you separately. If no paid plan applies, the service is provided as agreed with you.

8. Intellectual property

TAPE and its software, design, and branding are owned by us and protected by law. These Terms do not grant you any rights in them except the limited right to use the service.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted or error-free, or that third-party integrations will always be available.

10. Limitation of liability

To the maximum extent permitted by law, TAPE will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the service.

11. Indemnification

You agree to indemnify and hold TAPE harmless from claims arising out of content you upload or publish, your use of the service, or your breach of these Terms or of any connected platform's terms.

12. Termination

You may stop using TAPE at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to TAPE, its users, or connected platforms.

13. Governing law

These Terms are governed by the laws of India, and the courts of [your city], India will have exclusive jurisdiction, unless otherwise agreed with you in writing.

14. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the service means you accept the updated Terms.
